Privacy policy Lake Constance Boat Map
This policy explains which personal data the Android app “Lake Constance Boat Map” (German: “Bootskarte Bodensee”) processes. It is based on the Swiss Federal Act on Data Protection (FADP) and, where applicable, the EU General Data Protection Regulation (GDPR). For the website ungerlabs.ch, the website privacy policy applies.
1. Controller
Unger Labs, Florian Unger
Rossweidstrasse 21c, 9030 Abtwil SG, Switzerland
Email: hello@ungerlabs.ch
Unger Labs has no establishment in the EU. No EU representative under Art. 27 GDPR has been appointed, as processing is only occasional and does not involve a high risk.
2. In short
- The app needs no account and contains no ads, no analytics and no trackers.
- Your location is only used on the device and is not transmitted.
- Settings, your own places and downloaded maps stay on the device.
- For water level, wind, storm warnings, water temperature, the briefing and map data, the app fetches public data sources. They receive your IP address in the process.
- Push notifications are off until you switch them on. They are delivered through Google’s Firebase Cloud Messaging.
3. Location
When you show your location in the app, Android asks for your permission. Position, heading and speed are processed only on the device to show your location, your course and the 3D course view. They are neither stored nor transmitted to Unger Labs or third parties. The app only requests the location while it is open.
The position is determined by the operating system. On Android this is usually Google’s location services, which are subject to Google’s terms. The legal basis under the GDPR is your consent (Art. 6(1)(a) GDPR). You can withdraw it at any time in the Android settings; the app then works without showing your location.
4. Data on your device
The app stores on the device: your settings (for example language and draft), your own places and lists, which briefing items you have read, the downloaded high-resolution depth map, and the most recently loaded water level, wind and storm warning data so they are available offline. This data is not transmitted to Unger Labs. You can delete it by clearing the app’s data in the Android settings or by uninstalling the app.
5. Fetching public data
The app loads data directly from these providers:
- GitHub Pages of GitHub, Inc., 88 Colin P. Kelly Jr. Street, San Francisco, CA 94107, USA: wind forecast, Lake Constance Briefing, water temperature, seamark updates and the high-resolution depth map. Unger Labs prepares this data from open sources and publishes it there.
- PEGELONLINE of the German Federal Waterways and Shipping Administration, Germany: water level at the Konstanz gauge.
- Deutscher Wetterdienst (German Meteorological Service), Offenbach, Germany: official strong-wind and storm warnings for Lake Constance.
- Canton of Thurgau (open data portal data.tg.ch), Switzerland: water temperature, if the first source cannot be reached.
With each request, the provider receives technically necessary information, in particular your IP address, the time and the requested address. The app does not send your location or any identifier of yours. The legal basis under the GDPR is the legitimate interest in showing you current data (Art. 6(1)(f) GDPR).
6. Push notifications
In the settings you can switch on push notifications for important news. Android then asks for your permission. The app registers with Firebase Cloud Messaging, a service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, and Google LLC, USA. Firebase assigns the device an identifier and subscribes it to a topic for your language. Unger Labs sends messages to this topic and does not receive your device’s identifier.
The legal basis under the GDPR is your consent (Art. 6(1)(a) GDPR). When you switch push notifications off, the app unsubscribes the device from the topic; uninstalling the app invalidates the identifier. See Firebase’s privacy information for more details.
7. Google Play
The app is distributed through Google Play. Google’s terms apply to downloads and updates. Unger Labs receives aggregated statistics from Google Play, such as the number of installs and crash reports without personal details.
8. Contact by email
If you contact us by email, for example with feedback on the app, your address and the content of your message are processed in order to answer your request. The legal basis under the GDPR is the legitimate interest in answering enquiries (Art. 6(1)(f) GDPR). Emails are stored with the Swiss provider Infomaniak Network SA in Geneva.
9. Transfers abroad
GitHub and Google may also process data in countries outside Switzerland and the EEA, in particular in the USA. Transfers are based on certification under the Swiss-U.S. and EU-U.S. Data Privacy Framework and, in addition, on the European Commission’s standard contractual clauses, which are recognised by the Swiss Federal Data Protection and Information Commissioner (FDPIC).
10. Retention
Unger Labs stores no data about how you use the app. Data on your device stays there until you delete it. Business-relevant emails may be kept for up to ten years.
11. Your rights
Within the scope of applicable law, you have the right to access, rectification, erasure, restriction of processing, and to receive or transfer your data, as well as the right to object to processing and to withdraw consent. Please use the email address above.
You may also lodge a complaint with a supervisory authority: in Switzerland the FDPIC, in the EU the authority of your country of residence.
12. Changes
This privacy policy is updated when the app or legal requirements change. The version published here applies.
